Terms of service

1. Who we are

cafealty is a loyalty and post-purchase engagement platform operated for food and beverage businesses. These terms govern your access to and use of the platform, whether as a business subscriber or as a customer of a participating venue.

By creating an account, subscribing, or using any part of the platform, you agree to these terms. If you are accepting on behalf of a business, you confirm you are authorised to bind that business.

2. The service

The platform lets a participating business run a loyalty programme and offer post-purchase mini-games to its customers. Features available to a business depend on the subscription plan in effect.

We may add, change, or withdraw features. Where a change materially reduces functionality on a paid plan, we will give reasonable advance notice.

3. Accounts and access

A business is responsible for its own staff accounts, including keeping sign-in credentials confidential and deactivating accounts for staff who leave.

Actions taken through a staff account are attributed to that account in the operational record. You agree not to share credentials between people.

4. Customer data and loyalty balances

Loyalty points and balances are a record maintained by the platform on behalf of the participating business. They have no cash value, are not transferable between businesses, and are not a deposit or stored-value instrument.

A business is responsible for honouring the rewards it configures. We provide the mechanism that records eligibility and redemption; we do not supply the reward itself.

5. Fees, billing, and renewal

Paid plans are billed in advance for the period shown at checkout. Subscriptions renew automatically for successive periods unless cancelled before the renewal date.

Fees may change on notice. A price change takes effect from the next renewal, never mid-period.

6. Trials

Where a free trial is offered, its length is shown at sign-up. A trial gives access to the features of the plan it is attached to and ends automatically unless converted to a paid subscription.

7. Acceptable use

You agree not to use the platform to break any applicable law, including gambling, lottery, promotional, and consumer-protection law.

You agree not to misrepresent a reward, advertise a benefit you do not intend to honour, or use games to induce a purchase in a way prohibited where you operate.

You agree not to attempt to gain unauthorised access to another business's data, interfere with the operation of the platform, or reverse engineer any part of it except as permitted by law.

You agree not to use the platform to send unsolicited marketing to customers in breach of applicable rules.

You agree not to upload unlawful, misleading, or infringing content, including menu, reward, and branding material you do not have the right to use.

You agree not to automate access in a way that degrades service for others.

8. Suspension and termination

We may suspend or terminate access where these terms are breached, where use threatens the security or integrity of the platform, or where required by law.

You may cancel at any time. Cancellation and refund treatment is set out in the Refund and Cancellation Policy.

9. Availability and support

We aim to keep the platform available but do not warrant uninterrupted or error-free operation. Planned maintenance will be scheduled to minimise disruption where practicable.

10. Liability

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of goodwill, or loss of data arising from use of the platform.

Nothing in these terms excludes liability that cannot lawfully be excluded.

11. Changes to these terms

We may update these terms. The version and effective date shown on this page identify the text currently in force. Continued use after an update constitutes acceptance of the updated terms.
